Article 1 – Definitions
- Cooling-off Period: the period within which the consumer can exercise their right of withdrawal.
- Consumer: a natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
- Day: calendar day.
- Duration Transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
- Durable Data Carrier: any means that allow the consumer or entrepreneur to store information personally addressed to them in a way that enables future consultation and unaltered reproduction.
- Right of Withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
- Entrepreneur: the natural or legal person offering products and/or services at a distance.
- Distance Contract: a contract concluded within the framework of an organized system for the distance sale of products and/or services, using one or more means of distance communication until the agreement is concluded.
- Means of Distance Communication: any tool enabling the conclusion of an agreement without the simultaneous physical presence of the consumer and the entrepreneur.

Article 3 – Applicability
- These terms apply to every offer and distance contract between the entrepreneur and the consumer.
- Before concluding a distance contract, the terms are made available to the consumer. If this is not possible, it will be stated where the terms can be inspected and provided free of charge upon request.
- If the agreement is electronic, the terms can also be provided electronically in a way that allows storage on a durable data carrier. If this is not possible, it will be explained where the terms can be accessed, and they will be sent upon request.
- If additional terms apply to specific products or services, the most favorable provision applies in case of conflicting terms.
Article 4 – The Offer
- If an offer has a limited validity or conditions, this will be clearly stated.
- The offer provides an accurate description of products/services. Images are truthful. Errors do not bind the entrepreneur.
- The offer includes information on prices (including taxes), delivery costs, payment methods, execution, and terms.
Article 5 – The Agreement
- The agreement is established when the consumer accepts the offer and meets its conditions.
- If acceptance is electronic, the entrepreneur will confirm receipt. The consumer can cancel if no confirmation is received.
- Electronic agreements are secured by appropriate technology.
- The entrepreneur can check the consumer’s ability to pay and refuse orders with reasons if necessary.
Article 6 – Right of Withdrawal
For Products:
- The consumer can cancel within 14 days of receipt without giving reasons.
- During this period, the product must be handled carefully and returned in original condition and packaging if possible.
For Services:

Article 7 – Costs in Case of Withdrawal
- Return shipping costs are borne by the consumer.
- Refunds (excluding original shipping costs for full returns) will be processed within 30 days of cancellation or proof of return.
Article 8 – Exclusion of the Right of Withdrawal
- The right of withdrawal can be excluded if clearly stated before the agreement.
- Exclusions apply to custom-made, perishable, sealed, or time-sensitive products and certain services started with consumer consent.
Article 9 – The Price
- Prices will not change during the offer period unless due to tax changes.
- Variable prices due to market fluctuations will be clarified.
- Price increases after agreement are only allowed by law or if the consumer can cancel.
Article 10 – Conformity and Warranty
- Products/services must meet the agreement, specifications, and legal requirements.
- Additional guarantees do not limit statutory rights.
Article 11 – Delivery and Execution
- Orders will be delivered to the address provided by the consumer.
- Delivery occurs within 14 business days unless otherwise agreed.
- If delayed or unavailable, the consumer will be informed within 5 days and may cancel. Refunds will be issued within 14 days of cancellation.
- The entrepreneur bears the risk of damage or loss until delivery.
Article 12 – Duration Transactions
- Contracts for indefinite duration can be canceled with one month’s notice.
- Fixed-term contracts will not exceed two years and will continue as indefinite contracts after renewal.
Article 13 – Payment
- Payments are due within 14 days of receipt unless otherwise agreed.
- Consumers must report payment inaccuracies immediately.
Article 14 – Complaints Procedure
- Complaints must be reported clearly within 7 days.
- Complaints are addressed within 14 days, or an acknowledgment with a resolution timeline will be sent.
- Disputes unresolved with the entrepreneur can be submitted to the EU ODR platform (http://ec.europa.eu/odr).
Article 15 – Disputes
Dutch law exclusively applies to agreements under these terms.
Article 16 – Additional or Deviating Provisions
Additional or differing provisions will not disadvantage the consumer and must be recorded in writing or a durable data carrier.
